MHSSC Annual School Law Conference - Medical marijuana use has been legalized in NYS since 2014 and within the last year, its use may be prescribed to address acute pain management. As school districts are obligated not to discriminate against students and employees on the basis of disability, it is likely that schools will face growing accommodation requests from students and employees who are prescribed medical marijuana to treat chronic pain. The presentation will consider questions surrounding this issue, including: Can an applicant be denied a job based on a positive pre-employment drug test for marijuana if it was used as a result of a physician prescription? Does it matter whether the employee holds a safety-sensitive position? If students are prescribed medical marijuana to treat chronic pain, may it be administered during the school day?
